I don't know what is "scummy." I never understood that- the goal of mafia is to make people think you are a civilian. If there is a simple list of behaviors that automatically determine alignment, then the game of Mafia is pointless.
But Mafia isn't pointless.
Because there is no such list.

Second, you are assuming ALL the mafia are inactive if no kill occurs. I have no reason to believe that is the case. If even one mafia is active, there will be a kill, and the no-shows will never be addressed.
